Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the OneFast application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you ("User" or "you") and CannAppy ("we," "us," or "our"), the developer and operator of OneFast.

2. Description of Service

OneFast is an intermittent fasting tracker application that allows users to:

• Track fasting windows and elapsed time.
• Follow pre-set and custom fasting plans (e.g., 16:8, 18:6, 20:4, OMAD, extended fasts).
• View body phase information during fasts (glycogen depletion, fat burning, ketosis, autophagy).
• Log weight entries and mood/energy check-ins.
• View statistics, streaks, and historical trends.
• Receive electrolyte and safety reminders during extended fasts.

3. Not Medical Advice

You acknowledge and agree that:

• OneFast is not a substitute for professional medical advice, diagnosis, or treatment.
• You should always consult a qualified healthcare provider before starting any fasting program, particularly extended fasts exceeding 48 hours.
• Fasting may not be appropriate for everyone, including pregnant or nursing individuals, people with eating disorders, diabetes, or other medical conditions.
• You are solely responsible for your health decisions and outcomes related to fasting.

4. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. By using the App, you represent and warrant that you meet these eligibility requirements.

5. User Accounts

Creating an account is optional. If you choose to create an account to enable cloud sync and backup:

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information when creating your account.
• You agree to notify us immediately of any unauthorized use of your account.

6. Subscriptions and Payments

6.1 Free Tier

OneFast offers a free tier that includes core fasting tracking features, intermittent and extended fasting plans, body phase science, streaks and statistics, and electrolyte reminders. The free tier is available indefinitely at no cost.

6.2 Premium Subscription

OneFast Premium unlocks additional features including advanced analytics, weight tracking, data export, custom app icons, mood trends, and fast comparison. Premium is available at the following price points:

• Monthly: $4.99 per month
• Annual: $29.99 per year

6.3 Free Trial

New subscribers may be eligible for a 7-day free trial of OneFast Premium. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription at the applicable rate.

6.4 Auto-Renewal

All subscriptions are auto-renewing. Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.

6.5 Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the end of the period you have already paid for. We do not provide refunds for partial billing periods.

6.6 Price Changes

We reserve the right to change subscription pricing. Any price changes will be communicated in advance and will take effect at the start of your next billing period after the change. Continued use of the Premium subscription after a price change constitutes acceptance of the new pricing.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws.
• Attempt to reverse engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's servers or infrastructure.
• Use the App to collect or harvest personal information of other users.
• Redistribute, sublicense, or resell the App or its content.
• Use automated tools, bots, or scrapers to access the App.

8. Intellectual Property

The App, including its design, code, content, graphics, body phase science text, and all associated intellectual property, is owned by CannAppy and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.

9. User Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the App, you consent to the practices described in the Privacy Policy.

10. Disclaimer of Warranties

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the App will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy, reliability, or completeness of the body phase science information or any other content in the App.
• Warranties that the App will meet your specific health or wellness goals.

11. Limitation of Liability

To the maximum extent permitted by applicable law, CannAppy, its officers, directors, employees, agents, and affiliates shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of data, profits, revenue, or goodwill.
• Any personal injury or health outcomes resulting from your use of the App or reliance on its content.
• Any damages arising from your fasting activities, whether or not guided by information in the App.

In no event shall our total aggregate liability exceed the amount you have paid to us in the twelve (12) months preceding the claim, or $50, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless CannAppy and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

13. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App or by updating the "Effective Date" at the top of this page. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the App.

15. Termination

We may terminate or suspend your access to the App immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App will cease immediately. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Indemnification) will survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be resolved in the courts of the United States.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and CannAppy regarding the use of the App and supersede all prior agreements, representations, and understandings.
